    Coming back, but I find it funny that so many people (especially the viking fans) keep thinking that the Samurai would always win hands down. This was the closest one-on-one battle to date and due to the close results, these two warriors looked rather evenly matched one-on-one. If viking fans can't accept that a smaller warrior can match vikings in battle, then they need to get over themselves.

    i really think that the vikings would have won out in a real faceoff. the samurai have no real tactics for dealing with shielded foes having not had to face them in ages.

    you can see quite clearly that the viking even with the heavy shield would have imediately taken the little man with the big club out with a single hit of his axe to the back of the neck even with a broken arm and shield.
    sure the samurai would have hurt the viking but his momentum works against him there cause he isnt big enough to haul it up and defend himself before the viking kills him.

    further more the samurai may have been smart tactitons but they were also very very very traditional. the vikings could adapt in an instant to a new enemy having done it in almost every battle they faced, the samurai held on to their traditions even in the face of gunpowder. they would be cut down faster then they could become horrified by the vikings lack of honour.

    and im saying this as a realy big fan of samurai.

    "Samurai were only body guards." You guys ever read Japanese history? Opposing samurais clans would rage large scale wars against each other for the control of Japan. Samurai armies also fought off the Mongolian army twice. And lets face it the Mongolians were far more effective at barbaric warfare then the Vikings. The Mongol Empire was massive, yet they could not capture Japan thanks to the Samurai armies.

    Well myself as a teacher of history and greek mythology, I feel I must comment upon Tetsuru's mentioning the Samurai as poets and Haiku masters, which inveriably they were, and folks out there can make what they wish. On the one hand, in greek mythology the greatest hero, Heracles, could not even remotely do poetry or play an instrument; in fact he was compelled in his first labors because he lost his temper and killed his lyre-tutor. On the other hand, the deadliest hero by far in Homer's Iliad was Akhilleus, and in book IX, he COULD sing, compose poetry and play music. Make what you wish and I love this show guys!

    Well for watching this show as a teacher of history and greek mythology, I feel I must comment upon Tetsuru's mentioning Samurai Haiku and the issue of education. On the one hand, in greek mythology, the greatest hero, Heracles, could not create music at all; in fact he was compelled on his first labors to redeem himself because he murdered his lyre-tutor when he was 15. On the other, in Homer's Iliad the greatest war hero, Akhilleus, COULD sing, do poetry and he could do it very well; see Homer's Iliad book IX. Make what you wish and love your show guys!

    samurai is my fav i been livin the samurai code my hole life i just wish that samuari fought somone elese vikings are weak and they had that fight somone that has to wear chainmail and still looses omg too weak in my book vikings are fat and slow spartans are awsome tho

    Ok, honestly I think the viking should have been a little closer to winning or winning. First of all, the katana(the most popular samurai weapon) didn't penetrate the chainmail. A viking would usually either carry a one handed weapon and a shield or a greataxe. A great axe, even if it didn't cut through the armor, would beak bones from blunt forces. A viking with a shield would be even less likely to be taken down. In most cases, I'd imagine a average samurai with a katana instead of the real deal killer the kanabo. Over all, I'd like to see a re'do of this episode.

    I love both of them hehe would rule and yes Miyamoto Musashi is not a samurai he is a duelist of Japan and died of old age and unconventional at that he threw his short sword and fought with two katanas much like I like two long swords and I recommend his book "A Book of Five Rings" and Egil died in his 90's from a duel both duelist :P

    No I did not fail.You are saying you should always change your choice.Not so this is a lie what if you are right from start on your choice then you lose.You have a 33.3% chance to get it right from start.Ok what you are saying is the game show all ways opens a door with goat behind it when you chose one of three.This may not be so.They may only do it if you have the right choice because due to common psychology a person would commonly change choice and lose giving the show control.If you where wrong they don't have to do this and if so they could just open one with car and say sorry you lose.OK You don't say for sure if this method of elimination that they let you chose as they eliminate doors or they always chose a goat door.What I am saying you say always change your choice and you have 2 out 3 chance of winning this may not be so it would depend on circumstances by picking you have 33.3% chance of being right 66.6% of being wrong they show you a goat you change your choice because you see the goat knowing you had 66% chance of be wrong.but when you chance you lose your 33% chance of being right you have subtract this from your imaginary 66.6% chance of being wrong whats left 33.3%

    That would be awesome. Leonidas is probally my favorite person of all time but Hannibel was one of the biggest bad asses of all time. He totally dominated the Roman army with a much smaller force. Hannibel was such an awesome leader.

    Unfortunately that would be a mismatch of epic proportions. I'm a fan of the Samurai but the Knight's armor is just too thick to deal any real damage. That match could only go to the knight. They need to give each side a chance of victory in these match ups.

    Another great Aftermath, but the question on every fans mind, and it's one that's been circulating since the beginning of the show, when are you going to do the episode that everyone wants to see, Max Geiger's hair vs. Kieron Elliott's accent?



    Beyond that, how about in season 2 doing a fan's choice episode or something along those liens, see who the fans want to see fight each other? It would be cool to see who would win in a battle between a samurai and a knight settled once and for all.

    Point 3-Strength and size. The second biggest problem in your whole post. I am proof that size and strength don't always win a fight. I'm only about 5-8 and 180 pounds. I routinely used to fight and beat people who were equally skilled in martial arts who outweighed me by at least 40 pounds and once even beat a man who outweighed me by 120 pounds. My two best friends are both over 6 feet tall and they even acknowledge I'm more dangerous than both of them. Even without introducing these facts, you seem to have never studied how the samurai trained. During the period that it appears the show took the samurai from they were at their absolute peak. They had wars to fight regularly and had trained furiously since the age of 7. The samurai were not a group of physical weaklings. Mastery of Yumijutsu/kyujutsu (Japanese archery) took great strength. The bows were 7 feet tall and ridiculously difficult to pull back. Samurai were capable of firing it several times in rapid succession. If you'd done any research into the other side you would have that data.

    Point 4-Afraid of death? This is the moment where any credibility you had died. I repeat. DIED! Samurai and vikings, if they had anything in common, it was that neither was afraid of death. If you think the samurai were afraid to die you really need to open a book on the samurai. They believed the greatest honor was to die in battle. They actually went into battle hoping and planning to die. Ritual Suicide was part of the SAMURAI CODE! That's actually part of the cultural reason they didn't carry a shield. Bushido required a samurai to be willing to die at a moment's notice. Again, if you actually knew anything about what you were talking about, you'd have known that.

    So, now I hope you have learned something from this. Remember, it's better to keep your mouth shut and be thought a fool, than to post ignorant, foolish, and poorly researched information and confirmed as one.

    Oh boy. Usually I'd ignore a comment like this but it¿s so ridiculous I just can't leave it alone. I'm glad you enjoy Viking history and find your heritage fascinating. However, you seem to be woefully uninformed about the Samurai. I will proceed to pick your post apart one point at a time.

    Point 1- The sword. Yes, the katana did nothing against the chain mail. That is indisputable. However, the viking didn't have that mail everywhere. He didn't have it on one of the places that the Samurai loved to attack; the back of legs! (interestingly, one of the few things the final choreographed battle at the end depicted correctly imo).

    point 2-The only weapon that could do major damage was the kanabo or the Yumi? Those are definitely two heavy hitters (even though seriously, the kanabo was not a common weapon at all and even a small amount of research will reveal it). However, the naginata and the katana both do something that they don't show testing for in the episode. They can stab just like any sword. A naginata is a far more dangerous weapon than it showed with a variety of uses in the hands of a skilled samurai. I think I've already made my case for the katana about being where you slash.

    Vikng should have totally won! I've researched, and learnt about Vikings (cause they are so cool) and in the testingthe samurai sword didn't do anything to the chainmail the only weapon that could of done major damage for the samurai is the kanabo (which is really cool by the way) and the bow, The vikings were also strong and big (from their life-style) and would have loved to go into battle and die to go to Valhalla, while the samurai would still have the fear of dying, a man who wants to die in battle or one that dosn't.

    I'm also doubtful of the Kanabo, I mean, it was heavy as hell, who the hell even used that thing? I'm just curious, and maybe it would have been good to include the other spear that the Samurai used: the Yari, which was a thrusting spear. But yeah, I'm satisfied with whoever won this fight because these were my two favorite warriors from history.

    Also remember this the viking was the size of an average man now days in good physical condition he would have been lean not fat do to the diet of the era and extremely healthy.Would you consider an average size individual in top physical condition on a good diet who trained regularly in speed and combat slow that not a super heavy weight 170 to 180 lbs is it?So why would the viking be so slow he was not fat at all and well built. The samurai on the other hand was 5' 2" to 5' 3" about 120lbs to 130 lbs about size of 12 year boy who ate mostly grains with moderate exercise and combat training would you picture him that much faster than the average size person ?Basically samurai weapons where lighter to make the usable by Samurai. Viking weapons where heavier by a small amount because they where just is fast as the samurai weapons to the viking do to strength.Samurai armor was lighter as well due to size and weight that would be appropriate.Viking weapons where designed to defeat heavy armor which the viking could wear no problem do to larger size and strenght but rember he is only average size of a man now days in top health.

    There was not junk food in the 9th century and every one did hard work to survive no one sit or their arse :P

    The main problem is the viking was portrayed as an Idiot .Not only did they say Brains against brawn.They also had him running with shield on back holding two war spears not to made to be thrown (having a shorter range due to size and weight and he would not have 2 of them unless javelin size) at an archer.They said he just picked up his weapons and learn to use them by swinging them at people not minding to explain they where passed down tactics and techniques practice since the child was big enough to pick up a sword and walk many said to be giving to them by the all father himself.The dint mention not all vikings where raiders they where explorers,merchants and settlers.
    Women had equal rights if not more the Bride price was given to them and the had the right to Divorce their husband at any time by throwing their wedding dress down and saying I Divorce thee 3 times.Women could vote and fight as well if they wished some names of viking raiders on ships that where documented where female.

    The viking was not a body builder by modern standards he ate a well balanced diet with extreme exercise from daily life style/war training and was the size of an average person now days 5'10" about 170 to 180 lbs this would not make him slow.The average samurai ate an entirely different diet mostly carbohydrates less exercise/mostly technique training and was about 5'2" to 5'3" and weighted about 120 to 130 lbs he was said to be equal in size and build to a 12 year old modern male.Now I am sorry from my years of experience in heavy fighting I have seen skilled fighters men,women and youths fight.The larger opponents do gain advantage from being taller and stronger.they have more reach and it is harder to protect your head from over head shots when fighting sword and shield plus they can push you around and off balance with shield(I have seen people knocked to the ground this way). The bigger concern here is the samurai has no shield at all. the way the armor they whore was designed to stop slashing weapons with some one using a lighter weight weapon of there force potential of a 5'3" 130lbs person not the kind of force the European list field had nor caliber of weapon to penetrate armor.Samurai had no experience against shields either nor where any weapon they used design to get around them.The kanabo was not used either.So in my opinion from years of heavy fighting the samurai's chance of winning was greatly influenced by these factors not even considered properly on the episode and chance should be smaller than what he was afforded by modern stereotyping and martial arts promotion and media portrayal of the samurai and his skill. This is speaking from experience in fighting many styles even the samurai's, European and viking and from a realistic not fantasy and historical based Background .

    Well, while Royce Gracie isnt a lightweight, but only 1 weight class up (welterweight - 170), he has fought many who have outweighed him greatly and defeated many of them.

    Remco Pardoel - 250lbs - submission - lapel choke

    Patrick Smith - 225 lbs - submission - strikes

    Kimo Leopoldo - 235 lbs - submission - armlock

    Dan Severn - 250 lbs - submission - triangle choke

    Ken Shamrock - 235 lbs - Submission - rear naked choke



    Now while I did choose one of the greatest/well known fighters in UFC history, you can see that it can be done, and has been done. I also omitted a few victories, such as Akebono (484 lbs) and others, as they had lopsided losing records or the only fight ever and obviously arent that good.

    In this video the samourai would win, agaisnt a regular viking warrior, a more even matchup would be a beserker, but thats not the first point i want to make

    firstly, i'm sorry but here is the broblem with the great axe and katana being titled "short ranged" weapons, they were long, very, very long, also, it doesnt matter about range and power if your great axe hits nothing and/or gets blocked/deflected

    secondly, when your using a shield, and i cant stress this enough, when your using a shield, you don't sit there and let them hit your shield squarly! you turn your shield slightly so most of the forc e continues downwards/sideways and let you shield take SOME of the impact, letting a enemy hit your shield squarly is a very good way to break your arm, get killed

    thirdly, a viking warrior was a viking peasant, yes, they were a warrior nation, but what do you think they did when they got back home? thats right, farm, a beserker on the otherhand, was a fighting machine, if you wanted to live and you were near a beserker, you stayed away, a samourai was a skilled, disiplined warrior, so they would be a good matchup, skill, training, impressive armour, and disipline, versus, raw power and incredible skill,

    fourthly, this is a problem i hav e with every episode, this show, is impossible, you just can't show human intuitiomn and the effects of pain in a simulartion porgram, not if you want it open ended.

    fifthly, i notice that people in this thread are saying samourai only fought agaisnt other samourai, not true, i'll make a list of the poeple samourai fought(or the ones i kn ow of):mongols(yes, mongols) samourai, peasants(because that counts for somehting) and ninjas

    I have done tonnes of research and know plenty about the samurai and even more bout vikngs due to a couple of war history and ancient war university classes, and I say hands down there is no way a samurai would best a viking in one on one nor a larger battle, back then samurai were 130lbs average, look at men today who weigh this much they are super small by viking standards, the vikings were very skilled and even if the samurai has an edge skill/knowledge wise, its not that much more skill/knowledge anyway, ask any ancient war expert/professor and they would not be bias to either side, however they would all say Viking takes the cake (and by cake I mean samurai ass;))

    Great episode and aftermath. I thought the samuri would win showing discipline over ferocity. I was rooting for the Viking. After the testing, I felt it was a real toss up. My guess is that the bow was the difference maker, although unlike the Gladiator shield, the Viking shield did seem large enough to be able to defend effectivelly against arrows. It is likely that the Viking would be injured somewhat before getting close enough to engage the Samuri in close quarters.

    I do think the weapons tester for the Samuri was way too big and strong to give an accurate representation of the damage a typical Samuri would go against traditional Viking defenses. As close as this simulation was, any inaccuraries, however slight could have changed the outcome.

    I've recently been reading the book The Curious Incident of the Dog in the Night-Time by Mark Haddon. The main character gives one scenario he dubs the Monty Hall Problem which I like alot. Everything about it is fictional, but the overall message can be applied easily to this debate. Here's how it goes:



    A woman claiming to hold the Guiness World Record for the highest IQ works for a magazine as a columnist who answers math problems. Here is one problem she received: "You are on a televised game show, and there are three doors in front of you. One door hides a car, while the other two hide goats. You are asked to choose the door which you think hides the car. However, instead of opening the door you chose, the host, who knows what's behind each door, opens one of the other doors and reveals a goat. You are then asked whether you want to keep your choice or change. What should you do?"



    The columnist said that you should always change your choice because that way, you have a 2/3 chance of getting the car. But if you uesd your intuition, you'd figure that you'd have a 50-50 shot. The columnist received many letters from many mathematicians, all yelling at her to admit her mistake and fix it. But she never apologized, because in reality, she was always right. Look at the situation like this: There are 6 total outcomes. Of these 6, 3 involve changing your choice. Of these 3, 2 involve winning the car. The answer is 2/3, not 1/2 (50-50).



    The message is that unlike logic, intuition can be wrong.

    yup. samurai, you really shouldn't believe every thing 300 or tom cruise tells you. ok, I'll be fair, you shouldn't believe that all samurai, or even any, were Kill bill/ Anime samurai. they were really not AS good as those depict. now, the spartans did kick ass, but I would actually be very interested in a real viking vs spartan, or even knight.as they used similar tactics, as thrand said, sometimes better ones for one on one, and had more modern technology.

    The shield they speak of on the show would have had to be covered on both sides with raw hide not standard leather on show on just front side the shield was only 1/4 inch thick the shield wood is not what stops the blow the one they had was like over a 1" think it looked from side view and raw hide is what makes the strength. Their are two forms of shields construction one like plywood such as mine in my videos and a form of lamination of raw hide and leather much like plywood as well but better.My shield is only 1/4" oak in my video it dose not break or break the arm because they way it is held by a center boss.The Gokstad shields were approximately 7mm (1/4in) thick near the center and were chamfered so they were thinner at the edges meaning raw hide stitched to sandwich it to keep it from breaking because of butted planks which was not shown and 1"1/2" thick with metal bands the shield dint have no one could use it at all by center grip.

    Wow, this episode by far has inspired the most discussion and argument. I mean, just look at this comment board! We have full debates going on for practically every piece of armor and armament, not to mention the touchy issue of mindset and skill. Plus, the famous Thrand issue? This episode is great solely because of the controversy it sparked. You have to admire people for their persistance and loyalty.

    facts being facts the vikings were not the greatest one on one warriors. They lost. Sorry viking fans but those are the facts of the show. So while they may be great warriors they just are not the greatest. So far the greatest without the use of gunpowder are the apache, samurai, spartan, william wallace, and the others that actually won there fight. Sorry, but those are the facts of the show and cant be disputed. The show seems to be completely without bias, they just enter in the factual results they get from there tests and the computer spits out the results. The people that are putting together the shows are about 98-99% accurate about the warrior they are representing. So the fact that someone points out the viking had the wrong color on or someother pointless detail would not change the outcome of the fight. The show is really accurate, sorry someone has to lose but its the way it has to be. The samurai were just better one on one fighters.

    Viking's fans are bunch of sort losers... Viking are nothing more then the ultimate coward warrior of all time... They are such a pathetic people... Even I alone can beat 100,000 viking warriors in less then 60 seconds by two hand tie behind my back and blindfolded. All i need to do is fart once and all the viking warriors will drop like flies.... Like a plague pass through them like firestorm...

    As a Martial Artist, I would like to congratulate the team to Deadliest Warrior. There ways to produce data with what have is truly incredible.
    Now, what i want to see, and so does many, many people, is that you pit the previous warriors against previous warriors, but with different weapons.
    Also the Ninja vs. Spartan... Ninja should have won but the ninja team choose a worthless selection of weapons... why don't they watch some Naruto for god sake... I am not dissing the Spartan, because they are truly a deadly warrior, but if I would have chosen the ninjas weapons I would have chosen the Ninjato (standard ninja weapon), the Shuriken (standard throwing weapon), Black Eggs (It was really cool weapon), But I would have chosen the Tiger claw (preferably the 7-12 inch ones), and the Throwing spikes (because they are a weapon that can target vital organs, nerve points, and crippling points with pin point accuracy).
    There are also some points I would like to point out, (Taliban vs IRA) if you see a bomb next to you and its going tick tick, you don't stand there you run like your on fire or something!!!!!

    They didn't test true Samurai armor! It wasn't "steel plates" it was leather with very thin steel plates over it. The armor was very lightwieght and only good against japanese weapons. They also failed to say that Samurai only fiught 1 group of people: other Samurai. The average Samurai was about 5'2 whearas the average viking was about 5'10-6 feet. The armor would protect against slashes, but the heavy iron weapons of the Viking would crush the armor in no time. And who would swing an axe at the thickest partof the body!? Seriously??? I'd rather swing at the ribs or the shoulder. Both places are covered only by leather! The axe would go thru no problem! Even IF it didn't, broken ribs and collar-bone equals a heavily weakened Samurai! I think there were mistakes on both sides, and this episode should have been re-done. We SAW the Katana unable to pierce chainmail. The same would ahve been the case with the Naginata, at least the slashing motion.

7. WIRELESS MARKETING SERVICES AND PROMOTIONAL OPPORTUNITIES

Spike may provide users and viewers with the opportunity to register for special promotions, services, news, programming and information delivered via text messaging and other wireless Devices such as mobile phones. Users are required to provide their consent to receive such information from Spike, either by registering on this Site or via their wireless Device. Such services and promotional opportunities are provided by the Parent Companies or Affiliates for Spike. The information requested as part of the online registration process is a user's telephone number or a wireless email address, but only if specifically requested, and the carrier's name. Optional information may be requested for specific promotions, such as a user's preferences regarding goods or services, choices of music or artists, or other similar survey information. Depending on the promotion, we may also collect an Internet email address or other information and, depending on the information collected, the user may also be required to confirm his or her agreement to this Agreement and, including without limitation, the Privacy Policy.

Users that register for Spike's wireless marketing services acknowledge, understand and agree that they will be charged by the user's wireless carrier for all messages sent to the user from Spike. Standard messaging rates will apply, unless noted otherwise. Under no circumstances will Spike, the Parent Companies or any Affiliates be responsible for any wireless email or text messaging charges incurred by a user or by a person that has access to a user's wireless device, telephone number, or email address.

A user understands, acknowledges and agrees that Spike may, at its sole discretion and without liability to any user, terminate its offer of any specific wireless marketing service or all wireless marketing services at any time without advance notice. Spike may provide notice of terminations or changes in services on this Site.

8. VIRAL FEATURES

There may be portions of our Site, content, functionality or features (e.g, digital streaming media player(s)) ("Viral Features") that we make available to users for your personal use. While we can obviously change how, to whom and to what extent we make these Viral Features available at any time without any notice and in our sole discretion, so long as they are available to you, whenever you visit our Site or take advantage of any of these Viral Features (whether you use these Viral Features on your own personal or customized web pages, whether they are displayed or appear embedded or housed within a web page or website of anyone else, whether a commercial website or web page, an advertisement, promotional message or even a personalized or customized web page of a friend or through any Device that can access any of these Viral Features) you agree not to download any content made available as part of the Viral Features and acknowledge that such content is available only for streaming viewing and, further, that you are bound by the applicable provisions of this Agreement and our Privacy Policy.

9. POSTINGS

Your comments, suggestions and information are important to us. Portions of this Site may provide you and other users an opportunity to participate in forum services, blogs, web communities and other message and communication facilities ("Communities") and may provide you with the opportunity, through such Communities or otherwise, to submit, post, display, transmit and/or exchange (a) information, ideas, opinions, messages or other information ("Post" or "Postings") and (b) User Content (as defined in the User Content Submission Agreement, your submission of which is also governed by the terms and conditions therein, and considered a Posting for purposes of this Agreement. You understand, acknowledge and agree that such Postings are the sole responsibility of the person from which such Postings originated. This means that you are solely and entirely responsible for the consequences of all Postings that you upload, post, email, transmit or otherwise make available via the Site. Postings do not reflect the views of the Site, Spike, the Parent Companies or the Affiliates. We reserve the right to monitor, edit or screen any Postings. If we determine, in our sole discretion and judgment, that any Posting does or may violate any of the terms of this Agreement, we reserve the right, at any time and without limiting any and all other rights we may have under this Agreement, at law or in equity, to: (a) refuse to allow you to Post; (b) remove and delete Postings; (c) revoke your right to use the Site; and/or (d) use any technological, legal, operational or other means available to us to enforce the provisions of this Agreement, including, without limitation, blocking specific IP addresses or deactivating your registration on the Site.

If a Posting originates from you or your account, you hereby agree that: (a) you specifically authorize the Site, Spike, the Parent Companies and their Affiliates to use such Posting in whole or in part, throughout the universe, in perpetuity in or on any and all media, now known or hereafter devised, and alone or together with or as part of other information, content and/or material of any kind or nature; (b) you represent and warrant that (i) the Posting is original to you and/or fully cleared for use as contemplated herein, (ii) the Posting does and will not, in any way, violate or breach any of the terms of this Agreement, (iii) the Posting does not contain libelous, tortious, or otherwise unlawful information, infringe or violate any copyright or other right, or contain any matter the publication or sale of which will violate any federal or state statute or regulation, (iv) the Posting is not obscene or in any other manner unlawful, (v) the Posting shall not be injurious to the health of any user, and (vi) we shall not be required to pay or incur any sums to any person or entity as a result of our use or exploitation of the Posting; and (c) if your Posting incorporates the name, logo, brand, service or trademark, voice, likeness or image of any person, firm or enterprise, you specifically represent and warrant that (i) you have the right to grant the Site, Spike, the Parent Companies and their Affiliates the right to use all such Postings as described above, (ii) the Posting was produced in compliance with all applicable laws and regulations and (iii) for any User Content Posting that contains original videos, you will comply with any applicable identification verification and record-keeping requirements, and you will secure and maintain the requisite personal information and identification documentation for all individuals who appear in any such original videos, as may be required by law and/or otherwise requested or required by us in connection with our corporate compliance policies and practices, which includes (y) the individual's full legal name, current address, date of birth and (z) a legible photocopy of a valid government-issued identification document (e.g., a U.S. passport, state driver's license or valid photo ID card) to verify the individual's identity. With the submission of each such Posting, MTV, the Parent Companies and the Affiliates reserve the right to request that you, and upon such request you must, deliver a full and complete set of such identification verification records to us, as well as a legible photocopy of your valid driver's license, passport or other acceptable government-issued photo identification for our verification and record-keeping purposes. In addition, you specifically acknowledge and agree to abide by our policies regarding governmental certification procedures relating to the foregoing identification verification and record-keeping procedures and, if applicable, you will promptly comply with any specific requests or directions we give you in connection with Postings you submit that may be subject to these requirements.

You understand, acknowledge and agree that we have the right to delete, re-format and/or change your Postings in any manner that we may determine (although you will not be responsible for any such changes made). The amount of storage space on the Site per user is limited. Some Postings may not be processed due to space constraints or outbound message limitations. You understand, acknowledge and agree that we assume no responsibility for deletion of Postings or any failure to store, receive or deliver Postings in a timely manner or any other matter relating to Postings. Posting is for noncommercial purposes only and you may not Post in any manner which does or is intended to promote or generate revenue for any business enterprise or commercial activity.

10. CONTESTS, SWEEPSTAKES, AUCTIONS AND PROMOTIONS

From time to time, Spike, the Parent Companies, the Affiliates or the Site's operational service providers, suppliers, and Advertisers, may conduct promotions on or through the Site, including, without limitation, auctions, contests and sweepstakes ("Promotions"). Each Promotion may have Additional Terms and/or Rules which will be posted or otherwise made available to you and, for purposes of each Promotion, will be deemed incorporated into and form a part of this Agreement.

11. CERTAIN PRODUCTS AND SERVICES

a. RSS Feeds and Podcasts
    The Site may provide RSS Feeds ("RSS Feeds") consisting of selected text, audio, video, and photographic content ("Content") from the Site that is provided over the Internet using an XML feed. Certain RSS Feeds may be podcasts ("Podcasts") which may include as part of the Content an associated audio, video and/or photographic file where the audio and/or video file may be downloaded and played from a user's Device or transferred to a portable listening device. Certain software and hardware is required for users to download and view and/or play Content through RSS Feeds.

    Content is protected by U.S. Federal and State laws, and applicable foreign laws, regulations and treaties, and all rights in and to the Content are reserved to Spike or the content provider. Content is available for personal, noncommercial use only and you may download, copy and/or transfer to a Device or through a Device to another Device the RSS Feeds and associated Content for your personal, non-commercial use only. You shall not, nor will you allow any third party to, reproduce, modify, create derivative works of, display, perform, publish, distribute, disseminate, broadcast or circulate to any third party, or otherwise use any Content except as expressly authorized in this Section 11.

    By your access to and use of RSS Feeds, you understand, acknowledge and agree that the Site, Spike, the Parent Companies and their Affiliates do not warrant that its RSS Feeds will operate on all user equipment. Please see the "Disclaimer and Limitations of Liability" section below for further details.

b. Virtual Reality Features
    Portions of this Site may provide eligible users with certain virtual reality applications or features, including without limitation the Avatar (as defined in the Virtual Reality Applications - Terms) creation and customization tool, the virtual reality application communities and environments, and the Virtual Reality Commerce Functionality (as defined in the Virtual Reality Applications - Terms. All use of such applications or features is governed by Additional Terms as set forth in the Virtual Reality Applications - Terms.

c. Mobile Applications
    If Spike offers products and services through applications available on your wireless or other mobile Device (such as a mobile phone) (the "Mobile Application Services"), these Mobile Application Services are governed by the Additional Terms governing the applicable Mobile Application Service. We do not charge for these Mobile Application Services unless otherwise provided in the applicable Additional Terms. However, your wireless carrier's standard messaging rates and other messaging, data and other rates and charges will apply to certain Mobile Application Services. You should check with your carrier to find out what plans your carrier offers and how much the plans cost. In addition, the use or availability of certain Mobile Application Services may be prohibited or restricted by your wireless carrier, and not all Mobile Application Services may work with all wireless carriers or Devices. Therefore, you should check with your wireless carrier to find out if the Mobile Application Services are available for your wireless Device, and what restrictions, if any, may be applicable to your use of such Mobile Application Services. If you change or deactivate your wireless telephone number, you agree to promptly update your Mobile Application Services account information to ensure that your messages are not sent to the person that subsequently acquires your old number.

    Under no circumstances will Spike, the Parent Companies or any Affiliates be responsible for any wireless email, text messaging or other charges incurred by a user (or any person that has access to a user's wireless device, telephone number, or email address) using any Mobile Application Services.

12. HYPERLINKS TO THIRD PARTY SITES

The appearance, availability, or your use of URLs or hyperlinks referenced or included anywhere on the Site or any other form of link or re-direction of your connection to, with or through the Site, does not constitute an endorsement by, nor does it incur any obligation, responsibility or liability on the part of, the Site, Spike, the Parent Companies or any of their Affiliates, any of their successors and assigns, and any of their respective officers, directors, employees, agents, representatives, licensors, Advertisers, suppliers, and operational service providers. We do not verify, endorse or have any responsibility for any such third party sites, their business practices (including their privacy policies), or any goods or services associated with or obtained in connection with any such site, whether the Site's, Spike's, the Parent Companies' or any of their Affiliates' logo or sponsorship identification is on the third party site as part of a co-branding or promotional arrangement. If any third party site obtains or collects Personal Information from you, in no event shall we assume or have any responsibility or liability. 13. DEACTIVATION/TERMINATION OF YOUR REGISTRATION OR USE

If you are registered to use the Site, you may deactivate your account on the Site, at any time and for any reason, by logging in to your account, clicking "Profile" or your display name at the top of the Site and then selecting "Manage Account" and following the instructions to deactivate your account. We may terminate your use of and registration on the Site, at any time and for any reason, with or without cause, without prior notice to you and without any liability or further obligation of any kind whatsoever to you or any other party.

Notwithstanding any claim that a sole or exclusive remedy which is provided in this Agreement may or does fail of its essential purpose, you specifically acknowledge and agree that your sole and exclusive remedy for any loss or damage shall be to have the Parent Companies, upon written notice from you to us, attempt to repair, correct or replace any deficient goods or services under this Agreement and, if repair, correction or replacement is not reasonably commercially practicable for the Parent Companies, to refund any monies actually paid by you for the Products involved and to terminate and discontinue your use of the Site. You further understand and acknowledge the capacity of the Site, in the aggregate and for each user, is limited. Consequently some messages and transmissions may not be processed in a timely fashion or at all, and some features or functions may be restricted or delayed or become completely inoperable. As a result, you acknowledge and agree that the Parent Companies assume no liability, responsibility or obligation to transmit, process, store, receive or deliver transactions or Postings or for any failure or delay associated with any Postings and you are hereby expressly advised not to rely upon the timeliness or performance of the Site for any transactions or Postings. 15. INDEMNIFICATION

You agree to indemnify, defend and hold the Site, Spike, the Parent Companies, and any of their Affiliates, or any of their successors and assigns, and any of their respective officers, directors, employees, agents, representatives, licensors, Advertisers, suppliers, and operational service providers harmless from and against any and all claims, actions, losses, expenses, damages and costs (including reasonable attorneys' fees), resulting from any breach or violation of this Agreement by you, or public posting of your Postings.

The Parent Companies reserves the right to assume, at its sole expense, the exclusive defense and control of any such claim or action and all negotiations for settlement or compromise, and you agree to fully cooperate with the Parent Companies in the defense of any such claim, action, settlement or compromise negotiations, as requested by the Parent Companies.

16. ADS AND MALWARE

We take great care and pride in creating this Site. We are always on the lookout for technical glitches that effect how the Site works. When we find them on our end, we will fix them. Unfortunately, your home computer may cause some glitches that effect how you see our Site -- and that is beyond our control.

If you experience any unusual behavior, content or ads on the Site, it may be the result of Malware on your computer. Malware -- short for MALicious softWARE -- is a term used to broadly classify a form of software which is installed in a computer system with malicious intentions, usually without the owner's knowledge or permission. Malware includes computer viruses, key loggers, malicious active content, rogue programs and dialers, among others. 18. LAW THAT APPLIES TO THIS AGREEMENT; MISCELLANEOUS TERMS

This Agreement, together with any Additional Terms, Rules, our Privacy Policy and any other regulations, procedures and policies which we refer to and which are hereby incorporated by reference, contains the entire understanding and agreement between you and the Site and supersedes any and all prior or inconsistent understandings relating to the Site and your use of the Site. This Agreement cannot be changed or terminated orally. If any provision of this Agreement is held to be illegal, invalid or unenforceable, this will not affect any other provisions and the Agreement will be deemed amended to the extent necessary to make it legal, valid and enforceable. Any provision which must survive in order to allow us to enforce its meaning shall survive the termination of this Agreement; however, no action arising out of this Agreement or your use of the Site, regardless of form or the basis of the claim, may be brought by you more than one (1) year after the cause of action has arisen (or if multiple causes, from the date the first such cause arose).

This Agreement and your use of the Site is governed by, construed and enforced in accordance with the internal substantive laws of the State of New York (notwithstanding the State's conflict of laws provisions) applicable to contracts made, executed and wholly performed in New York, and, for the purposes of any and all legal or equitable actions, you specifically agree and submit to the exclusive jurisdiction and venue of the State and Federal Courts situated in the State and County of New York and agree you will not object to such jurisdiction or venue on the grounds of lack of personal jurisdiction, forum non conveniens or otherwise. To the extent it may be applicable, you agree to opt out from and expressly exclude any applicability of the Uniform Computer Information Transactions Act. IN ANY ACTION OR PROCEEDING COMMENCED TO ENFORCE ANY RIGHT OR OBLIGATION OF THE PARTIES UNDER THIS AGREEMENT, YOUR USE OF THE SITE OR WITH RESPECT TO THE SUBJECT MATTER HEREOF, YOU HEREBY WAIVE ANY RIGHT YOU MAY NOW HAVE OR HEREAFTER POSSESS TO A TRIAL BY JURY.

a. Information We Collect that You Provide Us.

    i. User Registration. To the extent we offer user registration on the Site, to register as a member of the Site, you are required to select a user name and password (together, your "User ID") and may be required to also provide other Information, such as your email address and date of birth. Additional Information may be requested during the registration process (but not required).

    ii. In Connection with Certain Features and Functions. We may also provide you with access to certain features or functions that we may offer on the Site, such as the option to subscribe to a selection of free email newsletters and other periodic information, chat rooms, message boards, electronic mail services, messaging services, auctions, shopping, registration and member profile pages.     The Site and/or third parties may use "cookies", "web beacons" (also known as image tags, GIF or web bugs), "embedded scripts" and other similar tracking technologies (collectively, "Tracking Technologies") to collect Other Information automatically as you browse the Site and the web.

4. Opting-Out of Certain Uses of Your Personal Information and Other Information (Other than Wireless Marketing Services and Associated Promotional Opportunities).

    i. In Connection with Marketing and Promotional Email and Offers.

    iii. Certain Continuing Rights Regardless of Opt-Outs. However, even if you exercise your opt-out rights above, we, or our Parent Companies or Affiliates, may continue to contact you for the other purposes described in the "Use of Information" Section above, such as for maintenance and administrative purposes.

    With respect to the Tracking Technologies set by Third Party Advertising Service Providers and Advertisers, you have a number of options:

    2. Opting-out to, deleting or disabling Third Party Advertising Service Providers' Tracking Technologies only means that such ads will no longer be tailored to your specific viewing habits or interests, but you will continue to see ads on this Site.

      With respect to the Tracking Technologies set by the Site, you have a number of options:

    1. You can choose to delete the Tracking Technologies through the "Internet Options" sub-option of the "Tools" menu option of your browser or otherwise as directed by your browser's support feature.
    2. You can choose to disable or turn Tracking Technologies off. Additional information on disabling or turning Tracking Technologies off may be available through your browser's support feature.
    3. You can choose to have the Device you use to access the Site warn you each time a cookie, image tag or other Tracking Technology is being sent, or you can choose to turn off such warnings.       Some Device manufacturers may preset their browsers to block Tracking Technologies from websites other than those you visit directly and, if so, certain services or advertisements may not work for such Devices. Further, if you delete or disable Tracking Technologies, you may not have access to certain features of the Site and some of our other services may not function properly.

5. Wireless Marketing Services and Associated Promotional Opportunities.

Spike may provide users and viewers with the opportunity to register for special Promotions, services, news, programming and information delivered via text messaging and other wireless devices such as mobile phones and, in the event we do so, users are required to provide their consent to receive such information from Spike, either by registering on the Site or via their wireless device. Such services and promotional opportunities are provided by the Parent Companies and/or Affiliates for Spike. The Information requested as part of the online registration process may include a user's telephone number or a wireless email address, but only if specifically requested, and the carrier's name. Additional Information may be requested for specific Promotions, such as a user's preferences regarding goods or services, choices of music or artists, or other similar survey information. Depending on the Promotion, we may also collect an Internet email address or other Information and, depending on the Information collected, the user may also be required to confirm his or her agreement to this Privacy Policy and the Terms of Use Agreement.

We caution that most wireless transmissions are not secured and there is a greater risk of an unknown third party's interception of messages or a user's Personal Information when using a wireless communications device.

Users that register for Spike's wireless marketing services acknowledge, understand and agree that they will be charged by the user's wireless carrier for all messages sent to the user from Spike. Standard messaging rates will apply, unless noted otherwise. Under no circumstances will the Site, Spike, its Parent Companies or Affiliates be responsible for any wireless email or text messaging charges incurred by a user or by a person that has access to a user's wireless device, telephone number, or email address.

    a. Registration. To the extent we provide wireless marketing services, there are two registration methods provided for Spike's wireless marketing services. Standard rate Promotions will be subject to either the "single opt-in" or the "double-opt-in" (Site/SMS) method, at the discretion of Spike depending on the type of Promotion. Premium rate services will require the "double opt-in" (Site/SMS or SMS/SMS) method.

    i. Single Opt-in Method: In response to print, radio, television, Internet, or other promotional messages, users will be directed to send a specific word or code via a text message to a designated telephone number to register for the service promoted. The user's voluntary submission of the designated word or code to Spike will mean that the user has freely and affirmatively granted permission to Spike to send text messages to him or her. Spike will thank the user for his or her registration by sending a "Thank you" message. The user may terminate the service at any time by using the unsubscribe command in any text message from Spike or by sending a text message to Spike that says "STOP", "END", "CANCEL", "REMOVE", "UNSUBSCRIBE" or "QUIT".

    ii. Double Opt-in (Site/SMS) Method: In response to print, radio, television, Internet, or other promotional messages, users will be directed to this Site to start the registration process. The user must affirmatively consent to Spike's sending of wireless messages to his or her designated wireless device by submitting a telephone number (or wireless email address, only if requested by Spike) and by clicking the consent statement on the Site's registration page. The user must also agree to the Site's Privacy Policy and Terms of Use Agreement before the online registration process is completed. Spike will then send a "Confirmation" message to the user's designated wireless device and will request that the user confirm that he or she has agreed to receive messages from Spike to that particular telephone number (or wireless domain name when appropriate). The user must respond to the "Confirmation" message with a text message that states "YES" or "Y" that will indicate the user's acceptance of Spike's wireless marketing service. Until the user responds to the "Confirmation" message, the user is not registered for the specific wireless marketing service subject to the Promotion. A user may respond to the "Confirmation" message at any time provided that Spike may choose to terminate offering wireless marketing service at any time and the user's response to the "Confirmation" is only valid if the response is received while Spike continues to offer the specific wireless marketing service.

    iii. Double Opt-in (SMS/SMS) Method: In response to print, radio, television, Internet, or other promotional messages, users will be directed to send a specific word or code via a text message to a designated telephone number to register for the service promoted. Spike will then send a "Confirmation" message to the user's designated wireless device and will request that the user confirm that he or she has agreed to receive messages from Spike to that particular telephone number (or wireless domain name when appropriate). The user must respond to the "Confirmation" message with a text message that states "YES" or "Y" that will indicate the user's acceptance of Spike's wireless marketing service. Until the user responds to the "Confirmation" message, the user is not registered for the specific wireless marketing service subject to the Promotion. b. Termination of Wireless Services by User. Regardless of which one of the above opt-in methods was used to register, users may revoke their consent to receive messages from Spike by the following procedure:

    A user may cancel one or more services via his or her wireless device at any time by using the unsubscribe mechanism provided by Spike at the time the message is sent, or by sending a text message that says "STOP", "END", "CANCEL", "REMOVE", "UNSUBSCRIBE" or "QUIT". Spike will terminate the user's registration for the most recent wireless service sent to the user. Any of these words followed by the word "ALL" in the user's termination request will cancel all of the user's registered wireless services with Spike. If the user unsubscribes from one or all of Spike service(s) via his or her wireless device, the service(s) will be terminated immediately and will cancel the user's previous opt-in.

    c. Termination of Wireless Services by Spike. A user understands, acknowledges and agrees that Spike may, in its sole discretion and without liability to any user, terminate its offer of any specific wireless marketing service or all wireless marketing services at any time without advance notice. Spike may provide notice of terminations or changes in services on this Site.

    d. Use of Information. Spike will not use a wireless telephone number, wireless or conventional Internet email address, or other Information submitted for its wireless marketing services for any other purpose but to provide the service requested, unless we provide advance notice of any other use. We will not share any Personal Information with Advertisers or other third party marketers unless you opt-in to such disclosure. We will share Personal Information with the operational service providers that assist us in delivering these wireless services to you and with the Parent Companies and Affiliates.

6. Sharing and Disclosure of Personal Information and Other Information.

    a. Sharing and Disclosure of Personal Information.

    Generally, we do not sell, rent, lease or disclose your Personal Information to third parties, except if you consent to such disclosure or as described in this Privacy Policy.

    i. Disclosure to Parent Companies and Affiliates. We may disclose Personal Information to Parent Companies and Affiliates for marketing and/or administrative purposes. You can choose to opt-out of certain such uses as described in the "Opting-Out of Certain Uses of Personal Information" Section above.

    ii. Disclosure of Certain Information in Postings Intended to Be Disclosed. Certain Personal Information associated with a Posting may be intended for disclosure ("Posting Information"), such as username. We will disclose Posting Information in connection with the display of, and other services relating to, such Posting.

    iii. Disclosure In Connection with Co-Branded Services and Features. The Site may also offer co-branded services and features, such as events and Promotions that we put together with another company or our Parent Companies or Affiliates ("Co-Branded Partner") and that may be hosted on the Site and/or our Co-Branded Partner's website. We may share your Personal Information with our Co-Branded Partner and your voluntary use of or participation in a co-branded service or feature means that you opt-in and give your affirmative consent to both the Site and our Co-Branded Partner to collect the Information provided in connection with the specific co-branded feature or service and to use such Information for the fulfillment of the feature or service and for marketing or administrative purposes. The Co-Branded Partner will be identified on the co-branded feature or service, along with the Co-Branded partner's privacy policy. If you wish to opt-out of a Co-Branded Partner's future use of your Personal Information for marketing purposes, you will need to contact the Co-Branded Partner directly and the use of such information by Co-Branded Partner is subject to Co-Branded Partner's privacy policy.

    iv. Disclosure to Operational Service Providers. We also have the right to disclose your Personal Information and Other Information to third parties for the purpose of administering and maintaining the Site's services, features, functions and operations. We will refer to these third parties as "operational service providers". We use operational service providers to efficiently provide the full range of content, activities, services, features and functions we bring you and we disclose your Information to operational service providers for the purpose of providing services to us.

    v. Disclosure to Certain Other Third Parties. In addition to the above, we will make your Personal Information and Other Information available to certain third parties in the following limited circumstances:

  1. When we are compelled to do so by a governmental agency, court or other entity (e.g., to respond to subpoenas, court orders or legal process) or if requested by a governmental agency or other authority as part of an investigation;
  2. If we believe your actions violate any law, rule, regulation and/or the Terms of Use Agreement, including, without limitation, this Privacy Policy, Rules or Additional Terms;
  3. In connection with Promotions, as necessary to administer the Promotion or as required by applicable laws, rules or regulations (for example, to provide winners' lists or make required filings as appropriate);
  4. If you opt-in or otherwise agree to have your Personal Information shared with or otherwise disclosed to a third party for marketing purposes, in which case the third party's use of your Information is subject to the third party's own privacy policy;
  5. If, in our sole discretion, we believe such disclosure to be necessary or appropriate: to investigate or resolve possible problems or inquiries; to protect our business and assets or the rights, property or safety of the Site, the Spike Channel, the Parent Companies, the Affiliates, or any of its or their operational service providers, licensors, suppliers, Advertisers, customers, users, or any other party; to limit our legal liability; to defend our interests; to enforce this Privacy Policy or the Terms of Use Agreement and/or to comply with our legal and regulatory obligations or requests by law enforcement agencies or governmental authorities and/or
  6. In the event of a bankruptcy, merger, acquisition, sale, transfer of control, joint venture or other business combination involving us, or our Parent Companies or Affiliates.

    b. Sharing and Disclosure of Other Information. We may share or otherwise disclose Other Information with third parties, but we do not disclose Personal Information to them except as described in this Privacy Policy.

7. Reviewing, Updating or Deleting Certain Information.

    Generally, you may review, update or delete certain Information collected by the Site by, if you are a registered user of the Site and logged into the Site, by clicking "Profile" or your display name at the top of the Site and then selecting "Edit Profile." However, Personal Information that is necessary to check eligibility, such as date of birth or age, cannot be deleted, but may be modified with sufficient verification of the correct information. We will allow you to change the password portion of your User ID, as well as certain other Information you have given us in order to keep your information current, but once you select a user name you will not be able to change that user name provided to us during registration and which is associated with your User ID.

    You may also exercise certain privacy settings options by, if you are a registered user of the Site and logged into the Site, clicking "Profile" or your display name at the top of the Site, selecting "Edit Profile" or "Manage Account" and selecting the "Privacy" tab.

    Certain Information collected for certain entries into Promotions are subject to corporate and regulatory recordkeeping requirements and will not be deleted upon the user's request, unless the entrant is a child under the age of 13 years old.

    If the burden or expense of providing access to your Information is disproportionate to the risks to your privacy or if the legitimate rights of others would be violated, we may decide not to provide access to such Information. In such cases, we will provide to you an explanation of why access cannot be provided and contact information for further inquiries.

    Children or Ineligible Teenagers. If we, or our Parent Companies or Affiliates, inadvertently send an email or text message to a person that does not meet the age and other eligibility requirements of the Site, such as a child (a person under the age of 13) or others who do not meet the greater age requirements of certain features of this Site ("Ineligible Teenagers"), the child (or Ineligible Teenager) or the child's (or Ineligible Teenager's) parent or legal guardian (the "Parent") always has the right to unsubscribe (opt-out) from receiving future emails or text messages via the unsubscribe mechanism contained in the email or message. The same unsubscribe process is available to a parent or legal guardian of a minor (a person under the age of 18, or the age of majority in your state).

    In addition, Parents of children or Ineligible Teenagers who wish to terminate their child's or Ineligible Teenager's membership must use their child's or Ineligible Teenager's User ID to gain direct access to the account, and follow the procedures in the "Deactivation/Termination of Your Registration or Use" Section of the Terms of Use Agreement to terminate their child's or Ineligible Teenager's membership. We will not allow direct access to a user's account and Personal Information by any person without the user's User ID. If a Parent does not have his or her child's or Ineligible Teenager's User ID, the Parent will be required to send an email to the Privacy Administrator that includes the Parent's name, address, telephone and email address, in addition to the child's or Ineligible Teenager's name and email address as registered on the Site, plus the child's or Ineligible Teenager's date of birth. The Parent must also provide verifiable identification that they are the parent or legal guardian of the child or Ineligible Teenager. Spike will send a confirming email to the Parent via the email address provided to verify that the Parent wishes to terminate his or her child's or Ineligible Teenager's account and registration. The Parent must then confirm by sending a reply email to the designated return address. Spike will then terminate the child's or Ineligible Teenager's account but will notify the child or Ineligible Teenager of the termination request via email and will identify the name, address and email address of the person making the request.

8. Protection of Information.

While no data transmission over the Internet is 100% secure from intrusion, we maintain commercially reasonable physical, electronic and procedural safeguards to protect your Information. However, regardless of our efforts and the Device you use to access the Site, it is possible that third parties may unlawfully intercept or access transmissions or private communications over an unsecured transmission. We conduct financial transactions via secured transmissions but may not always secure other parts of the Site. We also limit access to the Site by our own employees to those individuals who are authorized for the proper handling of such information and any employee found violating our standards of security and confidentiality will be subject to our disciplinary processes. We request that our operational service providers follow similar standards of security and confidentiality.

Phishing. Phishing attacks attempt to steal consumers' personal identity data and financial account credentials. "Phishers" use 'spoofed' e-mails to lead consumers to counterfeit websites designed to trick recipients into divulging Information such as credit card numbers, account usernames, passwords and social security numbers. WE DO NOT SEND EMAILS ASKING YOU TO PROVIDE OR CONFIRM CREDIT CARD NUMBERS, SOCIAL SECURITY NUMBERS OR YOUR USERNAME OR PASSWORD! If you receive such email communication, please forward it immediately to the Site's Privacy Administrator at spike-feedback@spike.com , and then immediately delete the fraudulent email from your computer.

9. Your California Privacy Rights.

If you are a resident of the State of California, we provide you with information on how to exercise your disclosure choice options such as your right to opt-out (which we may sometimes refer to as "unsubscribe") or opt-in for use of your Personal Information by third parties (such as Advertisers) for marketing purposes.     You are solely responsible for maintaining the strict confidentiality of your User ID, if applicable, and for any charges, costs, expenses, damages, liabilities and losses we incur or may suffer as a result of your failure to do so. You, and not us, are solely responsible and liable for the activity, behavior, use and conduct on the Site under your User ID (whether used by you or any others who use your User ID), unless and until you notify us that your User ID may have been compromised, misappropriated or improperly taken or used by another party. We reserve the right to deny access, use and registration privileges to any user, including without limitation, a registered user, of any services, features or functions of the Site if we believe there is a question about the identity of the person trying to access the user's account or any services, features or functions.

    Further, if you use any of the Communities features and functions made available on or through the Site, please remember that any Information disclosed in these venues is automatically made public and please use caution when disclosing any Personal Information in the Communities, as you do not know who will access and use your Personal Information or for what purposes.
