During the live Finale Episode of the Program, there will be an online voting element conducted during and in conjunction with the Program. The Voting period commences at the start of the broadcast 10PM and ends at 11PM (Eastern Time) of the program (the "Voting Period"). Any votes received prior to or after the Voting Period shall be considered void. Voter may only enter one (1) vote per on-line session during the Voting Period (i.e., Voter must close his/her web browser and re-open/start a new session on the voting website (the “Voting Website”) to cast another vote). Viacom Media Networks (“VMN”) reserves the right to modify these rules without notice.
During the Voting Period, Voter may cast his/her vote for their favorite of the thirteen (13) eliminated Contestants. The thirteen (13) eliminated Contestants eligible for voting will not include the three (3) final Contestants of the Finale Episode. The votes will be tallied during the live broadcast of the Finale Episode and the number of votes each of the thirteen (13) eliminated Contestant receives during the Voting Period will be added together into one vote total for each eliminated Contestant. The eliminated Contestant with the most votes will be given a spot as an Artist/Contestant on the next season of Ink Master (or Season 3), subject to the terms hereof. In the event of a tie in the most amount of on-line votes, VMN, CCCM Projects, LLC (“Producer”) and/or the Program Judges shall determine which of the tied Contestants is invited back. The eliminated Contestant who is given the opportunity to come back for Season 3 will be required to continue to meet the Program’s eligibility requirements and will be expected to execute and comply with any other rules or release forms required as a condition of their participation on Season 3 of the Program, subject to VMN’s and Producer’s discretion. In the event that the eliminated Contestant who is given the opportunity to come back for Season 3 elects not to return for Season 3 or does not meet the Program’s eligibility requirements, VMN and Producer shall not have any obligation to offer another eliminated Contestant an opportunity to come back for Season 3. In the event that VMN and the Producer elects to offer the remaining eliminated Contestants (based on the number of votes received from highest to lowest) an opportunity to come back for Season 3, all eliminated Contestants who are given the opportunity to come back for Season 3 will be required to continue to meet the Program’s eligibility requirements and will be expected to execute and comply with any other rules or release forms required as a condition of their participation on Season 3 of the Program, subject to VMN’s and Producer’s discretion.
Neither VMN, Producer nor their respective parents, divisions, subsidiaries and/or affiliated companies, licensees, advertising and promotional agencies, or any of and the directors, officers, agents, representatives, employees of each of them, are responsible for votes that are illegible, incomplete, lost, delayed, mutilated and misdirected, any problems or technical malfunctions, human error, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer on-line systems, servers or providers, computer equipment, software, failure on account of technical problems or traffic congestion on the internet or at any website or any combination thereof, including injury or damage to Voter’s or to any other person's computer related to or resulting from voting. If for any reason the voting is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the VMN which corrupt or affect the administration, security, fairness, integrity or proper conduct of the voting, VMN reserves the right at VMN’s sole discretion to disqualify any votes, and/or to cancel, terminate, modify or suspend the voting in any manner. Should the voting be terminated or cancelled prior to the stated expiration date, notice will be posted on the Voting Website, and any votes received prior to the termination or cancellation may at VMN’s sole discretion be considered by VMN. Votes that have been tampered with or altered will be deemed void. The use of any system or agent to submit votes in connection with the voting is prohibited and will result in disqualification of votes. VMN reserves the right at its sole discretion to disqualify any individual they deem to be tampering with the voting process or the operation of the voting or any website associated therewith; to be acting in violation of the rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. CAUTION: ANY ATTEMPT BY A VOTER OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE VOTING IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, VMN AND THEIR DESIGNEES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH VOTER OR OTHER INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
All of VMN’s decisions regarding the voting rules, process and system and the results derived from the voting shall be final and binding, and not subject to challenge or appeal.
